The next Labor Management Meeting will be held on Tuesday, July 10th, 2018 at 9:00 AM at HQ. Click here to leave any suggestions for the meeting.
The next Board of Directors Meeting will be held on Tuesday, July 17th, 2018 at 2:00 PM at 1302 W Busch Blvd, the PBA building.
Any items to be included on either agenda must be presented no later than Thursday before each meeting.
New bylaws and constitution
Members, the voting ended yesterday and the new bylaws and constitution passed. Now that they are the new bylaws and constitution for the organization, we will post the forms for nominations for the upcoming board of directors. Just a reminder, the voting changed and so did the term years for the board of directors. Nomination forms will need to be turned into the Secretary/Treasurer (Gene Haines) by September 8th at 5 PM.
- Section 3. Staggered Terms- Effective with the election in November 2017, the 5 candidates who
receive the most votes shall serve a term commencing January 1, 2018 and ending December 31,
2021 (4 year term). The next 5 candidates receiving the most votes shall serve a term
commencing January 1, 2018 and ending December 31, 2020 (3 year term). Thereafter all
elections shall be based on three year terms.
- Only Active members as of ninety days prior to the general election shall be eligible to
vote in the general election. If a runoff is required, only those Active members who were
eligible to vote in the general election may vote in the runoff. The Secretary/Treasurer
shall compile a list of eligible voters and post such list on the Association’s website at
least 60 days before the election. Any Active member may challenge the eligibility of any
name on the list or petition to include a name not on the list, prior to the conclusion of the
last regularly scheduled Board of Directors meeting immediately before the pending
election where the Board of Directors shall consider and rule on any such challenges or
petitions at such meeting. The decision of the Board of Directors shall be final. Any
challenge or petition made after the deadline set forth herein shall be waived except that
the President shall have the discretion to bring a late filed challenge or petition to a
hearing before the Board of Directors at a special meeting called for that purpose at any
time before the close of voting at the election
- Section 3 – Only “Active” members as described in this Article III of the Constitution shall have
the right to vote or hold office within the Association. Provided, however, that Auxiliary (Reserve) members shall have the right to vote in elections for executive officers and the Board of
Directors, only, but shall not have the right to hold office.

The member is affected by payroll
fiscal year in the
15.3 Overtime. Employees shall receive credit or payment at
the rate of time and one-half (1-1/2) for all hours worked per Article 15.2 in
excess of 40.0 hours in a seven (7) City of Tampa/PBA (Officer-Sgt)
10/1/2016-9/30/2019 37 day cycle. Said hours worked in excess of 40 in a 7 day
cycle shall be credited or paid at 150%. Overtime for employees assigned to the
modified work schedule shall be calculated at the rate of time and one-half
(1-1/2) for all hours worked per Article 15.2 in excess of the assigned 34.3
hours or 45.7 hours as applicable. Employees
may bank up to a maximum of 80 hours in their compensatory time bank. Time not
used shall be paid at the end of the payroll fiscal year and/or prior to any change in the
employee's rate of pay. Credit for hours worked, the computation
of hours worked and the method of compensation for overtime shall be as set
forth in the appropriate Department S.O.P. provided, however, that compensatory
time taken off shall first be deducted from the compensatory time-bank.
18.3 Holiday Bank. A request
for usage of holiday time shall be submitted to the employee's immediate
supervisor on the appropriate form. Leave may be taken only after being
approved by the Department. Every employee shall be afforded the opportunity of
utilizing any accrued holiday time prior to the end of the payroll fiscal year
provided that management's scheduling needs are met. Banked holiday time shall be utilized
prior to the end of the payroll fiscal year, when balances
shall be reduced to zero, provided however that a maximum of 45.7 accrued,
unused hours shall be carried over to the next payroll fiscal year.
No payment for unused holiday time shall occur prior to separation or at any
18.4 Floating Holiday. Employees with one year of continuous service
may request to observe
one Floating Holiday during the payroll fiscal year in addition to the eleven designated
holidays specified in 18.1. A Floating Holiday shall be taken in one 8.0, 10.0,
or 11.4 hour increment as applicable to the employee's work schedule and shall
be requested in advance on the appropriate form and is not authorized without
the express approval of the supervisor. Floating Holiday time off shall not
count as hours worked for purposes of calculating overtime pay. In the event that an employee fails to
utilize the Floating Holiday within the payroll fiscal year, there shall be
no carry over of the unused time to the next fiscal year nor cash payment in
lieu of usage. Employees shall not be eligible for payment of
unused Floating Holiday upon separation from employment.

CY2019 - 12/1/19 - 12/14/19 Paid 12/20/19
The member is affected by the payroll calendar year in the
39.5 In the event that at the end of the payroll calendar year the
employee has not utilized accrued Incentive Leave for Safe Driving and/or
Firearms (39.2 and 39.3 above), said remaining Incentive Leave shall be paid at
the employee's regular rate of pay at the rate credited of 8.0, 10.0 or
11.4 hours per Article 39.1. In the
event that at the end of the
payroll calendar year the employee has not utilized accrued Incentive Leave for
Physical Fitness (39.4 above), time credited shall be forfeited.

What Every Officer Should Know
LEO Bill of Rights & Garrity
A law enforcement officer is entitled to the Law Enforcement Officers' Bill of Rights whenever that officer is under investigation and subject to interrogation by members of his/her agency for any reason which could lead to disciplinary action, demotion, or dismissal. Routine police inquiries and reports are not subject to the bill of rights protection since the officer is not "under investigation." Once the questioning or report becomes focused on the officer's conduct for disciplinary purposes, then compliance with Section 112.532, Florida Statutes, is required.
Every law enforcement officer has heard about the "Garrity Rule." Generally speaking, the Garrity Rule prevents "covered statements" from a law enforcement officer "obtained under threat of removal from office" from being used in any subsequent criminal proceeding. As explained by the US Supreme Court, a law enforcement agency, in the course of a disciplinary investigation, cannot compel an office to waive the immunity provided by the Fifth Amendment against self-incrimination.
